Family Gets $6.7 Million for Wrongful Death Suit
A wrongful death and personal injury lawsuit awarded an Illinois family $6.7 million this week. When the Carroll family was on its way to the pumpkin patch in 2008, a tractor trailer driven by Jeffrey Repec hit their pickup truck and killed mother and wife Tabitha Carroll, 32. Her husband, Randy, suffered from facial fractures, a broken spine, and respiratory failure, while their 3-year-old son Gabriel received head injuries, lacerations to the face, and two broken legs.
The settlement was finalized with Geils Farms, owner and operator of the tractor trailer, when a court in Kane County awarded the Carroll family $4.7 million for Tabitha's death, $1.5 million for her husband's injuries, and $300,00 for the injuries that Gabriel suffered from.
Repec was found to be high on marijuana at the time of the truck accident and is believed to have been driving at a high speed. He is serving a 45-month prison sentence after entering a guilty plea for aggravated driving under the influence of drugs.
