Settlement Awarded in Wrongful Death Case
A settlement was reached with the city of San Diego this week in the wrongful death lawsuit for Kenneth Charles Sully.
The 58 year old was riding his Ducati near the intersection of Cedar Street and Pacific Highway when a 17-year-old driver made a left turn, striking Sully and throwing him from the bicycle. He was later pronounced dead from traumatic head injuries. Although the lawsuit originally asked the city for $5 million, the legal team was able to obtain $1.8 million for Sully's family.
The Sully's legal team was able to show that "the turn lane's position combined with the position of the then existing traffic signals gave drivers the confusing illusion they had the right-of-way on a green signal to turn left on Cedar Street." As a result, the city was found to be at fault for Sully's death, not the young driver.
