Mercy Medical Center has agreed to pay $4.3 million to the family whose baby sustained permanent brain injury during childbirth.
The parents, Jared and Crystal Rinker, filed the medical malpractice suit against the hospital last year, for their daughter Jordan Rinker. The details of the payout have been kept private, as is usual in medical malpractice suits, however the details of the case itself have been released by the county probate court this month.
According to these documents, Crystal was brought to Mercy Hospital and later given Pitocin to ease her labor pains. As the labor progressed Crystal was given additional doses of the drug, however, the nurses had failed to recognize that the uterus was signs of hyperstimulation; that is, the baby was showing intolerance to labor. When she was finally delivered, Jordan was considered dead until the medical staff revived her twenty minutes later. However, the damage done to her brain as a result of the Pitocin doses and the late delivery was permanent and irreversible.
