Surprise Ruling Given in Personal Injury Case
A case before one court in California could seriously change the course of personal injury law, not just in the state, but across the country.
Last week the court heard and ruled on a case where an accident victim was suing for medical costs. After reviewing the arguments presented by both sides, the court decided 6-1 that an accident victim can sue for the amount that the insurance company would have paid out, not the billed cost of treatments.
This is a major win for insurance companies that had millions of dollars on the line for this case. The victim in this case was a woman struck by a meat company truck. Her bills for the accident amounted to $190,000, but the insurer was only going to pay $60,000 to the hospital.
The woman sued and lost at the lower court level. When the Supreme Court returned from their recess, they concluded that the woman could not recover any additional monies as she didn't suffer any economic losses.
