Tragedy struck last year for the family of an elderly man. According to reports, the senior was at first sickened by eating a contaminated cantaloupe but later died from an illness. Now, his family is looking to file a wrongful death lawsuit against the farmer who sold the man the produce because they believe it caused his death. According to the wrongful death lawsuit filed in a Colorado court, the 92-year-old man developed a rare case of listeriosis, a bacterial infection that was transported by the fruit. He was one of 146 people affected nationwide by the bad cantaloupes.
What started out as a damage lawsuit was later changed into a wrongful death suit when the man lost his battle with listeriosis. His son filed the lawsuit and there are likely to be more filed in the future. In total, 30 people lost their lives by eating the contaminated fruit and one woman suffered a miscarriage. The elderly man spent five weeks in the hospital before succumbing to the disease.
