  Military Branches Sued by Boat Accident Victims

The United States and the Army Corps of Engineers are being sued by two women who lost loved ones in a boat accident that happened in a dam near Pittsburgh.

The daughter of Gary Watson, 59, and the wife of Brian Abercrombie, 26, are outraged over the incident that caused the death of their loved ones. On April 10 the two men from California, Pa., drowned when they boat capsized in the swift currents just upriver from Lock No. 3 in Harmar Township.

A third man is involved in this case, Watson's son Cale, who is also a plaintiff in the claims against the defendants. However, Cale is concurrently being sued by the women who allege that he contributed to the accident by steering the boat too close to the dam. He was injured in the accident but was able to swim back to shore safely.

The basis of their lawsuit is that there were no signs posted warning about the dangers of boating too close to the dam.

  Bike Accident Claims Life of Elderly Man

An Interstate 15 off-ramp was closed for several hours last week when a bicycle accident claimed the life of an older man in Mission Valley. The victim, who has now been identified as 60-year-old Marberry Acree, was one of two bicyclists who were traveling east on the ramp.

Around 11:50 a.m. near the Friars Road exit one of the cyclists passed the ramp to merge right while the other, Acree, attempted to merge right only to hit the right side of an eastbound truck. He then fell off his back and was run over by the truck.

At this time the truck driver has not been cited for the accident and police determined that no alcohol was involved in this bicycle accident.

  Police Say Man's Death was Caused by Fall From Galf Cart

Although they aren't sure exactly what happened just yet, the California Highway Patrol believes that a man's death was the result of a fall from a golf cart. Since this incident technically involved a vehicle, the golf cart, the CHP was called in to this case that normally may not fall under their jurisdiction.

Gregg Lypps, 41, was out golfing at the Pala Mesa Resort when he was discovered to be injured. There were many people at the resort for an event that day, however, nobody has stepped forward to say how or why Lypps fell off the back of the golf cart.

According to CHP Captain Deb Schroder, "Unfortunately, there was a lot of people at this event and we just don't know right now who is actually involved." Investigators believe that an 18-year-old may have been driving the golf cart that Lypps was on, but that person has already retained an attorney and isn't talking to the press or the California Highway Patrol.

  Motorized Bike Rider Hits Tree

Police and emergency personnel had been holding out hopes for one man involved in a motorized bicycle versus tree accident, but Gary Galvin succumbed to his injuries earlier this week.

Galvin, 57, was driving off Mission Avenue near Barnes Street around 4:20 on Jan. 17 when his bike hit a tree. Investigators are still attempting to determine how the accident occurred and what the cause was. His body was discovered and rushed to Scripps Memorial Hospital La Jolla. The medical team there treated him for blunt-force head injuries even though he had been wearing a helmet.

He passed away around 3:15 the following Saturday as a result of his head injuries. Galvin lived in San Diego and was single.

The CHP is asking any witnesses to the accident to come forward.

  NASA Astronaut Injured during Bike Accident

A last-minute replacement was made for the upcoming launch of space shuttle Discovery after one of the astronauts was involved in a bike accident.

Tim Kopra, 47, is known to have been hurt in a bicycle accident but NASA is not providing any detailed reports about him at this time. According to Peggy Whitson, chief of the Astronaut Office at NASA Johnson's Space Center in Houston, "Time is doing fine and expects a full recovery, however, he will not be able to support the launch window next month. "

This would not have been the retired army colonel's first mission as Kopra has flown on two shuttle missions before. He also completed a tour of duty at the International Space Station and did a five-hour spacewalk.  NASA did report that his replacement will be fellow astronaut Steve Bowen.

  Caregiver Arrested for Elder Abuse

The Island Packet of Hilton Head, a local newspaper for the area, reported that a caregiver was arrested this week for elder abuse at an assisted care living center.

Sonia King, 41, has been charged with multiple counts of abuse of a vulnerable adult at her workplace, the Brookdale Senior Living center. She has been accused of slapping two women and making verbal threats to choke another woman while she was working on Dec. 31.

A spokeswoman from the center said that King was fired on Jan.10 after they learned about her actions. According to Beaufort County sheriff's deputies none of the victims received life-threatening injuries.

At this time it is not certain as to whether King has retained an attorney for her upcoming court proceedings.

  Mother of Five Dies during DUI Accident

A mother leaves behind five children after becoming involved in a drunk driving accident.

California Highway Patrol believe that alcohol was a factor in the accident that caused Virginia Esparza, 34, to lose control of her vehicle on Highway 119 while leaving a hit-and-run accident. She was a single mom whose children are devastated by their loss. The oldest and only daughter, 18-year-old Crystal Martinez, will have to fend for her family now that their mother is gone. An account will be set up for the children by the Esparza family at the Kern Schools Federal Credit Union in their behalf.

Esparza was on her way to pick up her boyfriend and, although police believe alcohol to be involved, her family is claiming that she was not a very frequent drinker and that this entire event seems out of character for her. Her boyfriend was a passenger in the car at that time and remains in the hospital in a coma at this time.

  Car Dealership Subjected to Defective Products Lawsuit

Defective products are to blame in a lawsuit involved the death of two people in San Diego. The car dealership responsible for selling the couple their vehicle has been asked by the court to pay a portion of the overall award monies of $14.4 million. At this time the exact amount they are responsible for has not been disclosed.

The two victims, Casey and Melanie Barber, were represented by their three young sons in court in the case against Mossy Ford and other defendants. The accident occurred on July 31, 2006, when a tire-tread separation caused Casey Barber to lose control of his Ford E350 Sportsmobile van. Their argument revolves around a faulty tire change by Mossy Ford that the defendants claim should have taken the tire out of service.

The opposing side argued that the rollover accident was caused by an object in the roadway and not the tire-tread separation.

  93 Year Old Woman Victim of Pedestrian Accident in San Diego

Tragedy struck in San Diego when a 93-year-old woman crossing the street was fatally struck by a pickup truck last week.

Although the victim's name has not been released to the press, it is known that she was a widow living alone in a nearby apartment.

According to police spokesman Gary Hassen the driver of the pickup did stop afterward and remained on the scene until police arrived. The driver of the 2007 Toyota Tundra appeared very upset when police arrived on the scene.

Paramedics arrived shortly after and began CPR along with other lifesaving efforts; these were continued at Sharp Memorial Hospital but to no avail. The Medical Examiner's office reported that the woman passed away at 11:39 that morning.

  Coast Guard Searches for Boat Accident Victims

A boat accident off the coast of Del Mar kept the Coast Guard busy for several hours searching for possible victims.

They were alerted to the site of the boat accident by a fellow boater who started noticing an accumulation of debris in the area, including a sail and a mast.  It appeared to be related to a boating accident, thus causing enough alarm to contact the Coast Guard, according to USCG Petty Officer Henry Dunphy.

Although a police boat crew was dispatched to retrieve the wreckage and a helicopter was dispatched by the US Coast Guard, no damaged vessels or victims were discovered.

  Toyota Agrees to Pay $10 Million in Wrongful Death Case

One of the cases that helped spark the nationwide recall of Toyota cars will finally be settled in court this week. The car company has agreed to pay $10 million to the family of a California state trooper and three relatives that were killed in a car accident.

This lawsuit is just one of many wrongful death actions and product liability suits brought against Toyota Motor Corp and its subsidiaries when its vehicles were discovered to have sudden, unintended acceleration in some of its products.

Although it was just one of several crashes, the fiery Aug. 28, 2009 incident brought intense media attention as it involved California Highway Patrol Officer Mark Saylor in his Lexus ES 350 sedan. As a result of the accident the government began to investigate similar cases and eventually led to the recall of over 6.5 million vehicles.

At the time of the hearing the amount of the Saylor settlement had been kept confidential; however, a judge has ruled since then to make it public.

  Man Struck and Killed by Garbage Truck

Tragedy struck in southwest Leavenworth County last week when a man was struck and killed by a garbage truck. Although Undersheriff Ron Cranor did not have too many details regarding the truck accident, such as the identity of the man killed, he did report that the accident occurred around noon on Ninth Street, south of DeHoff Drive.

According to Cranor, the man was riding on the back of the truck while on his job collecting garbage when he jumped off. Instead of landing on his feet he fell down and, not seeing him, the truck backed over Cranor. The garbage company involved is Honey Creek Disposal. The street they were on extends for just a short distance into Leavenworth County before coming to a dead end.

  Christmas Eve Results in Tragedy and Injuries Near Fredonyer Summit

Christmas Eve brought tragedy and injury to several people on Highway 36 near Fredonyer Summit.

Melva Marlatt, 62, was driving in her white Ford 2004 F-150 pickup with husband David Allen, 54, when it collided with a green 1996 Ford F-250 pickup. Marlatt lost her life in the collision while the driver of the second vehicle, Shawn Ray Anderson, 36, was only injured.

A report released by the California Highway Patrol shows that Marlatt was traveling eastbound on the highway when the vehicle started sliding on a curve and lost control, placing his truck in the collision pathway of Anderson's vehicle.

The two drivers were airlifted to Renown Medical Center to have their injuries treated. Other passengers in the vehicles, Melanie Anderson, 26, and Daryn Pearson, 6, were taken by ambulance to Banner Lassen Medical Center.

  Wrongful Death Claim Filed for Mesothelioma Related Death

The Meigs County Common Pleas Court received its first wrongful death case for mesothelioma on behalf of Margaret Valentino. There are also 26 other co-defendants listed that are seeking a judgment for liability for illness and death, breach of warranty, negligence, product liability, concealment, conspiracy and willful misconduct against several companies they believe to have wronged Margaret Valentino by exposing her to asbestos.

Mesothelioma is a rare and extremely aggressive form of cancer that is nearly always linked to asbestos exposure. It can take as long as 15 to 40 years to manifest itself in someone like Valentino was first diagnosed with mesothelioma in June2009. At that point the progression of the cancer was so great that she only lived another two months past that date.

  Rains Cause 30 Accidents in San Diego

Rains caused at least 30 crashes and minor flooding in San Diego on Monday. Between midnight and 3 a.m. 15 accidents were reported, and ten more were added to that figure between 6 a.m. and 7 a.m. according to officials with the California Highway Patrol. Luckily none involved major injuries.

Because of all the accidents that had already occurred a traffic advisory was issued around 6:50 a.m. on the Main Street on-ramp to north Interstate 5. One car knocked down a pole while another vehicle had overturned on the north Interstate 15 connector.

A large tree blocked Highway 395 south of Tecalote Lane, according to the CHP, and the Carmel Mountain Road on-ramp to northbound Intertate 5 was shut down due to flooding.  Country Club Drive and Quarry Road off state Route 125 were also shut down due to the rain.

  Nursing Home Abuse Results in Criminal Charges

Another sad case of nursing home abuse was brought before the courts today, this time in Pittsfield. The defendant is 47-year-old Deborah Baribeau, a phlebotomist at Berkshire Medical Center, was accused of battery and assault on a disabled person with injury. This charge had been upgraded to a felony during the course of her trial.

Baribeau reportedly assaulted a patient at the nursing home while drawing blood from her. The victim is a 59-year-old stroke survivor.

At this time, Baribeau is not returning any phone calls; it is not yet known whether she has decided to retain an attorney.

Since the incident occurred on October 7, Baribeau has been banned from returning to Springside, according to a spokeswoman from the nursing home. She was originally under contract to draw blood from Springfield's patients.

The prosecution already has a strong case against her as there were several eyewitnesses, including Springside employees and a supervisor. They saw Baribeau continue to take blood from the victim even after she pleaded with the phlebotomist to stop.

  Ten Rescued Following Boat Accident

When a fishing boat overturned after hitting rocks off the coast of Victoria, a group of diving instructors came to the rescue. Ten people were rescued off Point Nepean; however, one man was dead and several others were injured. There were a total of twelve people on the boat before the boat accident happened.

At that time, staff of Dive Victoria were returning from a diving trip when they stopped to rescue the ten people. Jason Salter, managing director of Dive Victoria, said that one of his divers went to the overturned boat to locate the other two passengers. "He was able to pull one man from inside the vessel and get him out clear of the vessel so the chopper could winch him to safety," Salter added.

The man that was rescued was flown to the Frankston Hospital and is reported to be in stable condition. The second man has been identified as 52-year-old Leigh Davies of Wallington. He had already perished by the time the diver reached the overturned boat.

  Family Files Wrongful Death Claim Against Bus Driver

A bus driver and the city of Columbia, Missouri, are involved in a wrongful death lawsuit when a motorcyclist was killed last summer. The family of Michael Heaston, 34, have brought the lawsuit against the city after a bus driven by Archie Smith, Jr. struck and killed him. In an interview with the Columbia Daily Tribune, Smith says that he had stopped at a stop sign but failed to observe Heaston on his motorcycle. 

Although the cyclist attempted to avoid colliding with the bus, he ultimately failed and was pinned under it for several minutes. Smith said he first realized that he had struck Heaston is when he heard the sound of the motorcycle's impact with the side of the bus. He looked out the window and saw Heaston on the ground next to him. 

The cyclist was rushed to the hospital where he would die shortly after. 

This lawsuit was filed on behalf of his wife, Jenny Heaston, his parents, Jackie and David Heaston, and his son, Jadin Heaston.

  Woman Pleads Guilty to Felony Hit and Run

Nicoll Koval, 23, was accused of hitting a man with her vehicle on a freeway ramp in Rancho Penasquitos and leaving the scene of an accident. She has plead not guilty to felony hit-and-run causing death. 

The nursing student is thought to be responsible for killing Albert Holman on October 19 when he was walking along the edge of the freeway. The accident occurred right around 1 AM east of the Black Mountain road off ramp. 

Holman had to leave his car behind when he experienced two flat tires. He had been out celebrating his 34th birthday with his sister earlier that evening. 

When officers finally arrived on the scene they report that his body was completely mangled beyond recognition. They were tipped off to the person involved when they found a license-plate holder for a Nissan. Koval then contacted police the next day. 

Police visited her home and found a 2008 Nissan Sentra with a damaged windshield and significant damage to the front end. In addition, one of Holman's shoes was found in the undercarriage of her car.

  Man Suffers Serious Injuries during Collision

A regular day at the convenience store turned deadly when a woman crashed her sedan into the business. Unfortunately a customer, Carlos Martinez, was in the path of the auto when it happened. She suffered serious facial and head injuries and was rushed to the hospital as soon as medical help arrived.

Teresa Petersen, the driver of the car, was driving on South Rancho Santa Fe Road when she veered off the road, crossed the 7-Eleven parking lot and crashed through the front door. The car went all the way through the store to back, hitting Martinez along the way. Petersen was also taken to the hospital to be examined.

At the time of the auto accident Deputy Tammy Bennetts estimates that she was traveling at a speed of about 40 mph. At this time investigators have not determined the cause of the accident and will continue to look into this case.

  Teen Gets Short Sentence for Drunk Driving Accident

A young man got a short sentence for the serious tragedy he inflicted on one family in San Diego. The 17-year-old boy, whose name is protected because he is in juvenile court, was drunk and high when he ran his car off of a road in Oceanside, killing a man and striking his grandchild. The 18-month-old boy will now be blind for life and has serious brain damage.

For his crime the juvenile received 480 days in a youthful offender program.

At the time of his prosecution two months ago, the boy pleaded guilty to felony drunken driving. The Deputy District Attorney Mary Loeb reminded Judge Dwayne Moring that the boy was also driving without a license when he lost control of his car on that fateful morning on October 18.

The older man and his grandson had been walking along the sidewalk at that time.

There were three other passengers in the car who fled the scene of the crime. Lucy Verde, the mother of the impaired child, criticizes the teen for failing to apologize until a month after the drunk driving accident occurred.

  Major Accident Leads to Five Deaths and Multiple Injuries

In the city of San Diego, law enforcement officers say they are on the lookout for a driver of a 1995-2000 Gold Honda Civic that is responsible for causing a fatal accident that left five people dead on Saturday, November 13, 2010.  Police say that the major collision took place on a two-lane highway in El Centro.

According to that California Highway Patrol, the driver of the Honda Civic had attempted to pass a group of motorcyclists which had 12 bikers in all. The driver of the car crossed into the oncoming lane and managed to clear the motorcyclists, but an oncoming Dodge Avenger swerved and missed the Honda.  However, the truck ended up slamming into the motorcyclists head-on.

It is said that for the motorcyclists as well as a passenger in the Dodge died as a result of the tragic crash.  In addition, it was reported that six people suffered injuries during the collision and five of those injured were considered to be in serious condition.

Police have reason to suspect that the driver of the Civic was operating under the influence.

  Police Cracking Down on Drivers Using Cell Phones

In San Diego, local law enforcement officers are saying that you should not talk on your phone while driving unless you have a hands-free device. This week in particular, police officers will be looking out for drivers who have cell phones up to their ears.

Officers from the California Highway Patrol say they plan to target places that are well-known for being car accident prone.  Officer Mary Bailey with the CHP said, "We are going to up our enforcement throughout the county and then, specifically, look for places where we know cell-phone usage is a contributing factor. People that are on the freeway or people at stoplights."

According to Bailey, in 2008, 1,200 drivers in the state of California were involved in car accidents and admitted that they were using their cell phones when the collisions occurred. During those accidents in particular, 13 people were killed and 900 suffered injuries.

  Pedestrian Hit and Killed in Honolulu

In Hawaii, a family is deep in grief this week after a pedestrian accident.

Local news sources say that a car accident took the life of 28-year-old Frank Iokewe Ryder IV.  He was a son, brother as well as an expectant father.

According to police in Honolulu, Ryder had been walking along the shoulder of Kahekili Highway at around 5 AM.  While he was walking, he was hit by a black SUV.

Maj. Thomas Nitta of the Honolulu Police Department said, "The car was heading southbound. We believe the victim was walking on the Mauka side of the Highway."

When questioned, family members did not know why Ryder was walking on the highway at such an early hour.  His brother said that Ryder had a vehicle and only reason he could think of was that maybe his car was not functional.

  Motorcyclist Killed on Highway 20

This week in Sutter County, it has been reported that a man from Orlando is dead after he was involved in a motorcycle accident. It is said that the man crashed his bike at 4:30 PM on Saturday night.

Allegedly, 62-year-old Douglas Allen Canadas was driving his 2009 Harley Davidson Fat Boy with a group of his fellow motorcyclists.

According to the California Highway Patrol, Canadas was traveling westbound on Highway 20 which is just west of Hammonton-Smartsville Road.  They believe that he took a turn too fast.  He then crossed into the eastbound lane and onto the dirt shoulder.  CHP officers do not believe that the motorcyclist was able to regain control of his bike and overturned and ejected him.

At this time, police plan to continue their investigations.
